Terms of Use
Last revised: March 6, 2026 (Pacific Time). By accepting these Terms electronically, using the Services, or completing a transaction through the Services, you agree to be bound by these Terms.
IMPORTANT NOTICE
These Terms include an agreement to arbitrate claims, waive class actions, and waive jury trials, plus disclaimers and limitations on liability.
These Terms govern your use of Kachyng products, websites, mobile applications, and related services (collectively, the "Services"). The Services include functionality that enables users to make payments to merchants or other parties selling goods or services using Kachyng to receive payment.
If you are a Merchant, your merchant-specific terms are available at legal@kachyng.com.
These Terms are a binding contract between you and Kachyng, Inc. ("Kachyng", "we", "us", "our"). Our Privacy Policy and Acceptable Use Policy are incorporated by reference:
1. Kachyng Account
You may create a Kachyng Account when completing a transaction on a merchant or partner website using Kachyng Services. Information submitted in connection with payment may become part of your account for future purchases.
2. Communications
You consent to receive communications from us by email, SMS, calls, and push notifications, including messages generated by automatic dialing systems for authentication, receipts, reminders, and account or transaction notices.
You may opt out via unsubscribe links, by replying STOP to SMS messages, or by contacting support@kachyng.com. Message/data rates may apply. Opting out may limit your ability to use Services.
3. Privacy
We take privacy seriously. Your use of the Services is subject to our Privacy Policy. Payment information used through your Kachyng Account is encrypted and stored in a secure token vault used for transactions.
4. Your Use of the Services
- • You must be at least 18 years old to access and use the Services.
- • If using Services on behalf of an organization, you represent you are authorized to bind that organization.
- • You may not impersonate another person or submit information you do not have rights to use.
- • You may not transfer your account without prior written permission.
- • You are responsible for safeguarding your account and all activity under it.
- • You agree to use Services only in compliance with applicable law, including export laws.
5. Payment Terms
Clicking "pay" authorizes the applicable Merchant to charge your selected payment method. For recurring transactions, you authorize recurring charges as agreed with the Merchant.
You represent and warrant that you are authorized to use the payment method and that payment requests are subject to issuer/network authorization. We may require OTP or additional verification information.
6. Fraud Prevention
You consent to our collection and use of account and verification information to confirm identity, validate payment, prevent fraud, and improve fraud detection.
We may close, suspend, or limit account access if identity cannot be verified, account security is compromised, or account use appears suspicious or nefarious.
7. Relationship with Merchants
You purchase goods/services from the Merchant, and your purchase is governed by terms between you and the Merchant. Kachyng acts as the Merchant's agent for transactions. Product, shipping, return, and warranty disputes must be resolved with the Merchant.
8. Ownership of Content
Services, content, updates, and related intellectual property are owned by Kachyng and licensors. Rights are licensed, not sold, except as expressly granted in these Terms.
9. Account Termination
You may terminate your account by contacting support@kachyng.com. Kachyng may suspend or terminate access at its discretion, including for breach of Terms.
10. Changes to Services or Terms
We may modify, suspend, discontinue, or limit Services and may update these Terms. If changes are material, we will provide notice by reasonable means. Continued use after effective date means acceptance.
11. Warranty Disclaimer
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KACHYNG DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SECURITY, ACCURACY, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW, KACHYNG IS NOT LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR AGGREGATE DAMAGES EXCEEDING $100, SUBJECT TO APPLICABLE LAW.
13. Indemnity
You agree to indemnify and hold harmless Kachyng, its affiliates, officers, agents, employees, and partners from claims, liabilities, losses, and expenses arising from your use of Services or violation of these Terms or applicable law.
14. Void Where Prohibited
Offers for features/products/services are void where prohibited. If you access Services outside the United States, you do so at your own initiative and are responsible for compliance with local laws.
15. Arbitration Agreement
Any dispute arising from or relating to Services or these Terms will be resolved by final and binding arbitration under the Federal Arbitration Act and California law, administered by the American Arbitration Association (AAA).
YOU AND KACHYNG AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A CLASS OR REPRESENTATIVE ACTION. IF A CLAIM PROCEEDS IN COURT, BOTH PARTIES WAIVE THE RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.

16. Additional Terms
- • Governing law: State of California (without conflict-of-laws rules).
- • Severability applies if any provision is invalid or unenforceable.
- • Force majeure applies for events beyond reasonable control.
- • Feedback may be used by Kachyng without restriction or payment.
- • Assignment restrictions apply unless authorized by Kachyng in writing.
- • California residents may contact support@kachyng.com and the California Department of Consumer Affairs as applicable.
